8. How to request access (Form 2)
To request a record of this private body:
- Complete the prescribed Form 2 – Request for Access to Record (Regulation 7), available from the Information Regulator: https://inforegulator.org.za/paia-forms/ (or the PAIA Forms section at inforegulator.org.za/paia).
- Submit Form 2 to the Information Officer by email to thulasizwen@emthunzinifs.co.za (copy compliance@emthunzinifs.co.za), or by hand / post to 35 Newquay, New Redruth, Alberton, 1449, or by another method the Information Officer accepts in writing.
- Attach proof of identity. If you request on behalf of another person, attach proof of authorisation.
- Describe the record sufficiently for us to identify it, state the form of access required, and (for a private body) identify the right you wish to exercise or protect and why the record is required for that purpose.
- Pay any prescribed request fee and, if applicable, deposit / access fees (see section 9).
We will acknowledge receipt and decide the request within the time periods in PAIA (generally 30 days, which may be extended once by a further 30 days on the grounds in the Act). You will be notified of the outcome using the prescribed Form 3 where applicable.
9. Fees
Fees payable for PAIA requests to a private body are the prescribed fees set out in the PAIA Regulations (including Annexure B), as updated from time to time by the Minister / published by the Information Regulator. They typically include:
- a request fee (not payable by a requester seeking their own personal information, where the Regulations so provide); and
- an access fee for reproduction, search and preparation, and related costs if access is granted.
We do not invent or vary the prescribed tariffs. The current schedule is available from the Information Regulator. Before processing a non-personal request, we may require payment of the request fee. Where search and preparation will take longer than the prescribed hours, a deposit of up to one-third of the estimated access fee may be required.
Payment details for fees: To be confirmed by the Director (Finance). Until published, ask the Information Officer for the current bank account details and the reference format (for example “PAIA-[your surname]-[date]”). Do not pay a fee until you have those details in writing from EFS.
10. Grounds for refusal
Access to a record may be refused on the grounds in Chapter 4 of Part 3 of PAIA, including (where applicable) where disclosure would involve:
- unreasonable disclosure of personal information about a third party;
- certain commercial information of a third party or of EFS (including trade secrets and confidential commercial information);
- information supplied in confidence by a third party;
- safety of individuals or protection of property;
- privileged information (for example legal privilege);
- research information in defined circumstances; or
- other grounds expressly provided in PAIA.
Mandatory disclosure provisions in PAIA may still require disclosure in the public interest in defined cases. Where only part of a record is refused, the remainder may be severed and disclosed where reasonably possible.
11. Remedies
EFS is a private body. There is no internal appeal process under PAIA equivalent to that for certain public bodies. If a request is refused, partially refused, or not responded to within the statutory period, you may:
- lodge a complaint with the Information Regulator using Form 5, within the time periods set out in PAIA / the Regulations (generally within 180 days of the decision or deemed refusal), emailed to PAIAComplaints@inforegulator.org.za or via the Regulator’s eServices portal; and/or
- apply to a court for appropriate relief within the periods allowed by PAIA.
